DEFINITIONS

1. In these Terms and Conditions the following expressions shall have the following meanings unless the context clearly otherwise requires:

'Aboran' means ABORAN STUDENT SUPPORT LIMITED (Company No. 070221176S England and Wales) whose Registered Office is at The Old Registry, 2, Cemetery Road, Shelton, Stoke-on-Trent, Staffordshire, United Kingdom, ST4 2DI.

"Intellectual Property Rights" mean copyright and all other intellectual property rights recognised by law from time to time;

"us" means Aboran and derivatives of `us' shall be construed accordingly;

"you" means the individual, person or company who has or who is deemed to have accepted these Terns and Conditions and derivatives of 'you' shall be construed accordingly;

words in the singular include the plural and vice versa and words in one gender include any other gender;

any reference to "persons" or "parties" includes natural persons, firms, partnerships, companies, corporations, associations, organisations, governments, states, foundations and trusts (in each case whether or not having separate legal personality);

any reference to a statute, statutory provision or sub-ordinate legislation includes such legislation as amended and in force from time to time and any legislation which modifies, consolidates (with or without modification), re-enacts or supersedes it; references to clauses and schedules are to clauses and schedules of these Terms and Conditions and references to sub-clauses and paragraphs are references to sub-clauses and paragraphs of the clause or schedule in which they appear;

headings are for convenience only;

any phrase introduced by the terms "including", "include", "in particular" or any other similar expression shall be construed as illustrative and shall not limit the sense of the words preceding these terms.

OWNERSHIP AND ACCURACY OF WEBSITE AND WEBSITE MATERIAL

2. This website and its materials arc exclusively owned by Aboran.

3. Intellectual Property Rights in this website and its materials are exclusively owned by Aboran unless otherwise stated and all such rights are reserved to Aboran.

You are responsible for complying with all applicable copyright laws. Aboran permits you to make copies of information on this website as necessary incidental acts during your viewing and you may take a print for your personal use of so much of the site as is reasonable for private purposes. All other uses are prohibited.

4. The website and materials include but are not limited to all text, graphics, images, photographs, logos, databases, software programmes created by Aboran and all other creative work or literature created or commissioned by or for Aboran.

PRIVACY AND THE DATA Protection ACT 1998
10. The Data Protection Acts 1998 to 2003 ("the Data Acts") provide the legal framework that defines how personal information can be used.

11. Aboran is fully committed to compliance with the Data Acts . The following principles will be applied when Aboran handles your personal information:

Your personal information is only used with your knowledge, but, if given, Aboran may on occasion provide your information to other departments within Aboran or to other third party agencies either for research purposes to help improve Aboran's customer services and this may involve contact with you by e-mail, post or telephone. Should you not consent to this use of your information (which you will have indicated during the registration process) then your information will he confined to use by Aboran solely to respond to your needs or enquiries from time to time and to save your needing to provide the same information every time you contact Aboran. The same principles as set out in this sub-clause 11(1) will apply to passing your information to third parties whom Aboran believes may have products and services of interest to you.
  2. In the event of Aboran or its business being sold or amalgamated with another business or company, any of your information which may be passed to advisers or others as part of this process shall remain subject to your expressed wishes regarding use of such information to the extent that Aboran is able to control such other parties.
  3. Strict security procedures are taken to avoid and prevent unauthorised or accidental access to your information.
  4. Only information that Aboran needs to ensure effective customer service is collected and retained and will be seen (should you have expressed such a preference) only by those within Aboran who need it to do their jobs.
  5. Your personal information may be passed to others or other organisations if Aboran is so required to do by applicable law.
  6. Your personal information will be retained only for as long as it is required by Aboran to ensure that your requirements and interests arc properly served and Aboran will, where necessary, keep your information up to date. Any inaccurate or misleading data will be rectified as soon as you draw this to our attention.
  7. Aboran will provide you with a copy of your personal information on request.

12. These principles set out above in clause (2) will apply whether Aboran holds your information on paper or in electronic form.

14. Aboran is the Data Controller of any personal information that you submit to Aboran. This means that Aboran is responsible for the safety of your personal information. However, other organisations that undertake work on Aboran's behalf may also see your personal information as and when this is necessary. Any organisation that works on behalf of Aboran must adhere to Aboran's rules on data protection.

15.As Data Controller, Aboran has a duty of care to ensure that its employees and those acting on its behalf, respect your right to confidentiality and ensure that information is only used for the purpose it was provided for.

16. Aboran reserves the right to withhold your personal information if this contains details about someone else unless the person in question has given their permission to disclose this information to you.

TERMS AND CONDITIONS
17. The Aboran Terms and Conditions currently in force apply to services supplied or undertaken by Aboran. Any person applying for any higher education course through Aboran is deemed to accept the Aboran Terms and Conditions.

18. A cookie is a small file that is stored on your computers hard drive by your web browser. It enables our website to remember you when you return to visit the website. Cookies help Aboran to provide you with a better experience by allowing Aboran to understand what areas of the website are of interest to visitors these cookies do not track individual information. GOVERNING LAW
20. These Terms and Conditions and your use of this website shall be governed and construed in accordance with English Law, and only the English Courts shall have jurisdiction in relation to any action or dispute arising
